Denver Grandfather, Filberto Alderete Kills Intruder

Filberto Alderete had faced a year of harassment from a local gang that had targeted his family. Alderete and his grandchildren could not leave their home without being harassed. On Sunday morning, it all boiled over. First, gang members started beating Alderete’s 25 year old grandson. Then they maced his 22 year old granddaughter. Alderete fired 2 warning shots and called 911.

When Jesus Sifuentes decided to barge in the front door, the 62 year old Afilberto Alderete realized he had no choice. In a back room in the house was his 35 year old mentally disabled daughter. According to ABC News, Alderete declared “They got to take me out, before they get to her,”

Alderete has been his daughter’s sole caretaker since his wife fied 3 years ago. He did what he felt he had to do. Unfortunately, in the chaos that ensued after the attack on the Alderete family, Alderete’s grandson was shot by police and arrested. Alderete spent 2 days in jail until the local District Attorney decided that Alderete acted in self defense. ABC News reports as follows.
Prosecutors decided the shooting was justified under Colorado self-defense and “Make My Day” laws, said Denver district attorney spokeswoman Lynn Kimbrough.

The “Make My Day” law states that a home occupant is “justified in using any degree of physical force” against an unlawful intruder if he reasonably believes the person “might use any physical force, no matter how slight, against any occupant.”

In the aftermath of the attack, the Alderete family is already being threatened by gang members and may have to relocate for their own safety. Alderete himself has been helped by cops to move to an undisclosed location. Hopefully, the costs of moving will not fall on Filberto Alderete and his family. And hopefully, his grandson will quickly be absolved of any wrongdoing as well.

There are RICO statutes that go after criminal organizations. It would be nice to see the gang that has tormented Filberto Alderete and his family face not only criminal charges but civil proceedings and asset forfeiture. For many urban residents, terrorism is not equated with Al Qaeda as much as it is local street gangs. Law enforcement needs to address the concerns of people like Filberto Alderete and his family. The gangs in Denver and elsewhere will not leave on their own. They will need some help in packing their bags from law enforcement.
